According to prosecutor J.C. Weydert, William and Frayba Tipton sent an email Wednesday, Nov. 20, to inform lawyer Russell Humphrey that he was no longer representing them.
Humphrey defended the couple during their trial for embezzlement. A jury found them guilty Aug. 8.
William Tipton was convicted of three counts of grand theft embezzlement and one count of perjury. Frayba Tipton was convicted of two counts of grant theft embezzlement and two counts of perjury.
Weydert said he wasn’t surprised by the news and he expected the couple to file for a new trial.
The couple was scheduled to be sentenced Tuesday, Nov. 19, but Frayba Tipton was taken by ambulance from the courthouse to San Joaquin General Hospital for an unknown illness.
The couple appeared in court together Thursday.
William Tipton declined to comment about the situation while standing in line outside the criminal clerk’s office.
The judge rescheduled the sentencing to 8:30 a.m. Friday, Nov. 22, in Department 14.
