Tracy couple found guilty of embezzlement

STOCKTON— A Tracy couple was found guilty on four felony counts each following a jury verdict in an embezzlement trial in San Joaquin County Superior Court on Thursday, Aug. 8.

William Tipton was found guilty of three counts of grand theft embezzlement and one count of perjury, while his wife, Frayba Tipton, was found guilty of two counts of grand theft embezzlement and two counts of perjury, according to Deputy District Attorney J.C. Weydert.

A 13-person jury — four men and nine women — read their verdict at 1:30 p.m. on Thursday after a day of deliberations following a seven day trial that was spread over nearly four weeks.

“I thought the jury was extremely conscientious and very diligent; serious about their responsibility,” Weydert said. “It was a very good jury.”

The couple was accused of keeping a 2004 Ford Mustang, 2006 Ford F250 pickup and a 2008 Ford Mustang Shelby Cobra without paying the lending companies after their purchases.

Weydert said the only question the jury asked during their morning deliberations on Thursday was to have the testimony of the two Tracy Federal Credit Union employees read back to them. Both employees had testified on the first day of the trial, July 19.

“Right at noon, we got a note that they reached a verdict,” Weydert said.

Judge Lauren Thomasson will formally sentence the couple on Sept. 30 in Department 14 of the Stockton courthouse.

Weydert said William Tipton could receive a maximum six-year sentence, while Frayba Tipton could around five years. Each Tipton would serve time in a county jail and not state prison.

The judge could also rule no jail time or home arrest.

Perjury carries a sentence of two to four years for each felony count, while embezzlement is 16 months to three years for each felony count.

The Tiptons must report to the San Joaquin County Probation Office to obtain a probation report, Weydert said.

Translation, they have not received any time at this point.

Tip, take note of the word "could"

"The judge could also rule no jail time or home arrest."

Suggestion, read a bit more carefully next time.

Wow, these people got more time then a sex trafficker. How pathetic is the system that people who keep cars or steal money from clients/gov't get more and/or same time then a sex trafficker???!

They haven't even been sentenced yet, how do you know how much time they are going to get? The article only lists the possible time they can get.
