Brother, sister plead guilty in fatal stabbing

STOCKTON — A brother and sister from Modesto pleaded guilty in San Joaquin Superior Court Thursday, May 9, for their involvement in the killing of 22-year-old Tracy resident Phillip Sanchez.

Victor Garcia, 29, pleaded guilty to voluntary manslaughter, personal use of a knife and being a felon with prior prison time for auto theft and drug possession. As part of the deal, Garcia agreed to serve the maximum sentence of 13 years in state prison. Formal sentencing will happen on June 3.

Samantha Garcia, 22, pleaded guilty to being an accessory after the crime of voluntary manslaughter. That charge carries a maximum time of three years in state prison, but her deal calls for her to serve the minimum of two years.

Judge Bernard Garber accepted the siblings’ plea.

The pair allegedly went to Sanchez’s house on the 200 block of West Whittier Avenue before midnight on Sept. 19.

According to police reports, Victor Garcia was seen fighting with Sanchez prior to the victim collapsing on a neighbor’s front lawn with three stab wounds.

Sanchez was taken to Sutter Tracy Community Hospital, where he died an hour later.

After the Thursday hearing, Stephanie Cardoza, mother of the victim, called the ordeal “very hard.”

“Nothing they give them will ever bring my son back,” she said. “He will never get justice. It’s not fair. He was killed the day after my birthday. I’ll never celebrate another birthday.”

Cardoza said that members of her family are planning to speak during the sentencing hearing, at 9 a.m. June 3 in Department 23 in San Joaquin County Superior Court.

Both Victor and Samantha Garcia will remain in San Joaquin County Jail until the hearing.

I've been looking at this case since day 1. i cant believe they got very little years in prison i have two kids a boy and girl if my son got killed my heart would break our kids have to bury us not us bearing our children. i hope you heal over time.

To the family:

Be sure to get an attorney who specializes in torts. Be sure to file a wrongful death lawsuit.

That way when these two scumbags get out of jail they will owe you hundreds of thousands, maybe even millions of dollars in legal damages.

My daughter is Greg's cousin. She had a close bond with him. The morning I had to tell her that some idiots killed her cousin was one of the hardest things I've ever had to do. He had a daughter who adored him. A family that loves him. We all miss him. The slap on the wrist that Samantha & Victor are getting is nothing! He will never spend a day with his family EVER! But they will be out in a few years time to celebrate whatever there evil hearts desire. Where is the justice for Greg Sanchez??!! I'm sorry Steph & Philip & the rest of Gregs family for the injustice.

I agree, in this town a mexican life is not as valuable as a white man. If the victim had been the son of someone prominent and powerful the murderers would have gotten a harsher sentence. There is no justice for the poor.

Life is cheap in Tracy and San Joaquin County.

This is what happens when you have a cowardly district attorney, and cowardly judges.

Remember, these are the people who want to release more prisoners back into society. So they give murderers the lowest sentence possible.

Only 13 years for a murder. How much you want to bet this would be a higher sentence if this had happened to one of our city council members or their families? Then these guys would be in jail for life.

Chris...i agree! Philip was my son and yes it was very disappointing! I felt like they got a slap on their hand and the judge basically said now go and murder somebody else! Justice....never in my eyes there is no such thing. I lost all respect to the system! #From a mom with a broken#stephanie medina cardoso.
