David Splan, 42, of Tracy, and Brandon Gann, 31, of Stockton, are charged with premeditated murder, attempted premeditated murder, armed with a firearm during a felony, use of a firearm in commission of a felony, intentional and personal discharge of a firearm and street terrorism with enhancements.
Splan and Gann are both being held in San Joaquin County Jail in French Camp on $5 million bail.
Judge Franklin Stephenson granted the request by Splan’s attorney, Frederick Remer, and scheduled the case for further arraignment at 1:30 p.m. on March 28 in Department 35 of the Stockton courthouse.
Splan and Gann — who are each a member of the Hells Angels Nomad Motorcycle Club — are accused of beating and fatally shooting Daniel Martinez, 26, of Lathrop, and the shooting and beating of an unidentified 30-year-old man.
The alleged incident occurred around 6:30 p.m. on Aug. 17, 2011 in rural Manteca.
Martinez and the second victim were members of the Most Envied Motorcycle Club of Modesto, according to Deputy District Attorney Kevin Mayo. He said there had been allegations that the two motorcycle clubs had been quarreling at the time of the shooting.
Arriving deputies reported finding Martinez with gunshot wounds to his upper body. Paramedics pronounced him dead at the scene.
The second shooting victim was found a short distance away from Martinez. He was taken to a local hospital and has reportedly recovered from his injuries. His identity is being withheld by police for his protection.
Splan and Gann were indicted by a grand jury on Dec. 21 and arrested on Jan. 2.
