Tracy-area CHP spokesman Adam Shelton said Monday, Jan. 11, that the police report alleged Maldonado was under the influence of alcohol at the time of the crash.
Shelton said the officer’s report said Maldonado had a “strong odor of alcohol on his breath.” Since he was unconscious, Shelton said Maldonado could not be questioned at the scene.
The police report states the car Maldonado drove crashed between Ahern Road and Interstate 5, going through bushes and rolling over.
The report does not state which direction Maldonado was headed, though it does indicate he was the only person involved in the accident.
Maldonado sustained major head injuries and was flown by medical helicopter to Doctors Medical Center in Modesto, Shelton said.
His condition on Monday morning was listed as critical.
Shelton said blood was drawn at the hospital, but a blood-alcohol level will not be available until a toxicology report is completed by the Department of Justice crime lab in Ripon.
Shelton said CHP officials plan to file a criminal complaint against Maldonado with the district attorney’s office for driving under the influence of alcohol.
