Marcus Rogokos, 31, is scheduled to appear at 8:30 a.m. in Department 31 of San Joaquin County Superior Court to determine whether he is mentally capable of facing his criminal accusations.
He is charged with premeditated attempted murder, use of a firearm in commission of a felony, intentional and personal discharge of a firearm, assault with a semiautomatic firearm, shooting at inhabited dwelling and stalking.
According to Tracy police, Rogokos is accused of firing at least one bullet from a handgun into the am/pm at 2430 Joe Pombo Parkway around 8:40 a.m. Jan. 12, 2012.
Deputy District Attorney Ron Indran said in a Friday, Jan. 4, telephone interview that a courtroom was assigned for the competency trial during a hearing.
Indran said it is up to the defense to prove Rogokos is not mentally fit for trial.
“By law, he has to be found competent before we can go to trial,” Indran said.
Indran said an array of psychologists is expected to testify at the trial, which is likely to take a few days to complete.
Rogokos remains in custody in San Joaquin County Jail in French Camp on a no-bail status.
