Two men charged in the killing of 23-year-old Tracy resident Anthony Sosa Jr. on Feb. 4 will have to wait until October for their preliminary hearing, superior court officials decided Monday, Aug. 27.

Samuel Inguanzo, 18, of Tracy, and Manuel Pelayo, 19, of Stockton, were scheduled to have their preliminary on Sept. 10 in the Stockton branch of San Joaquin County Superior Court. But that date was changed to Oct. 9, Deputy District Attorney Tori Verber said, because the September date would have interfered with an unrelated murder trial she is also prosecuting.

Verber said Sept. 10 would have fallen in the middle of her ongoing trial and interrupted the trial of Inguanzo and Pelayo.

She said the prosecution and defense agreed Monday to move the preliminary to 8:30 a.m. on Oct. 9 in Department 35 in the Stockton court.

Verber said she anticipated the defendants’ preliminary to take two to three days, a period of time typical for a homicide case, she explained.

Inguanzo and Pelayo are accused of killing Sosa, who was found dead of multiple gunshot wounds on the corner of Walnut and 11th streets in the early morning hours of Feb. 4.

According to court documents, Pelayo is believed to have been the shooter, while Inguanzo was said to be aiding and abetting him at the time of the crime.

Pelayo and Inguanzo both are charged with premeditated murder, street terrorism, personally and intentionally discharging a firearm, and carrying a concealed and loaded firearm.

Pelayo faces additional charges of being armed with a firearm during a felony, use of a firearm during a felony and intentionally discharging a firearm with great bodily injury. He is being held in San Joaquin County Jail in French Camp on $4 million bail.

Inguanzo’s additional charges are for allegedly being an accessory after the fact, and being a prior felon in possession of a firearm while under the influence of narcotics. Inguanzo remains in county jail on $2.9 million bail.

According to a member of Sosa’s family, the victim was planning for a future with his wife and their 4-month-old son at the time of his death. The family member described Sosa as “the best all-around guy” who loved his wife, his child, and he was considered to be a proud father.
