His Voice: Congress must pass reasonable gun control

As the last of the Sandy Hook Elementary School victims were being placed in the final resting ground, the country began its search for an answer for this senseless killing by an apparently deranged young man.

For the first time in over several decades, the incident has put the National Rifle Association and the supporters of guns on defense.

However, it is yet be seen whether the Newtown, Conn., tragedy is going to be the impetus to passing any meaningful gun-control law, specifically banning assault rifles and high capacity magazines, which are solely designed to kill the maximum number of people in the shortest possible time.

The pro gun lobby wrongfully believes that the intent of the Second Amendment was to allow individuals to bear arms for fighting against government tyranny, instead of protecting gun ownership in the context of a well-organized militia in case of the foreign invasion, as the framers intended.

Despite championing states rights and individual rights, there is no indication whether even Thomas Jefferson and other federalists were supportive of the Second Amendment for the reason espoused by many pro-gun supporters.

In the 1939 case U.S. v. Miller, the Supreme Court made a ruling that “The Second Amendment must be interpreted and applied with a view to its purpose of rendering effective the militia.”

In 1980, in Lewis v. U.S., the Supreme Court reaffirmed the 1939 ruling made by the Miller court that “the Second Amendment guarantees no right to keep and bear a firearm” that does not have “some reasonable relationship to [445 U.S. 55, 66] the preservation or efficiency of a well-regulated militia.”

Yet, thanks to the NRA and their hard-knuckle politics and the about-face of a Supreme Court ruling in District of Columbia v. Heller, most people seem to believe that the individual right to gun ownership is guaranteed by the Second Amendment.

One week after the Sandy Hook massacre, Wayne LaPierre, the NRA leader, addressed the killing in a hyperbole-filled press conference by defending gun ownership and blaming the killings on everything but guns.

Outside the Fox News brigade and Rush Limbaugh, LaPierre’s comments generally received a swift and negative reaction. Even Republicans distanced themselves from his cold comments.

Yet many conservative politicians have remained quiet, and Congress has been incommunicado about a matter that takes more lives in one month than the attacks of Sept. 11, 2001.

From Columbine to Connecticut, each massacre seems to have two common denominators — access to a high-powered gun and a mental health issue.

Despite insurmountable influence by the NRA and the pro-gun lobby in Congress, passing a gun control law to restrict assault weapons and unlimited ammo may be relatively easier than legislatively addressing the mental health issue.

Mental health has been the most neglected part of the health care system, is significantly underfunded by Congress and overlooked by the general public.

While accessibility of providers is the forefront of the mental care issue, the legal guardianship of the mental health patients, which under the current laws is difficult to change, is also an important factor.

We cherish the individual rights granted by the Constitution and must keep defending those rights, but no right is more important than right to live.

Therefore, Congress must look at the gun violence in totality and find the right balance between the individual’s right to live and right to own a gun.

We must show the same urgency to address this madness as we have shown the determination to stop terrorist attacks after 9-11. Congress must do its duty to protect its citizens by passing a law that has a reasonable chance to stop senseless violence.

I support limited abortion in cases of incest, rape, or if the mothers life would be at risk by giving birth, I do not own a gun, therefor I believe the only bias I have here is towards common sense.

Oulawing abortion would stop abortion unless someone decides to break the law.

Outlawing guns, not certain types, let just say all guns, get rid of every one of them on the face of the earth, killing would continue without breaking the gun laws.

There's the difference. An abortion is an abortion but killing can be done in a lot more ways than using a gun.

Let's see and I'm just winging it, knives, baseball bats, golf clubs, a clothes line, rope, rags, water, a pen, a razor blade, oh wait, what does it take to put it all together? Hands, yep, people have been killed with someones bare hands, the same hands it takes to use one of the aforementioned weapons.

Even if we ban all guns killing unfortunately will continue virtually unabated until we fix the real problem which is a society in decline. Unless people are deaf, dumb, & blind, we are regressing as a society.

The dog & pony show going on in Washington right now is a joke. Nobody wants to tell the truth, we have a failed education system, a decline in quality parenting, a generation who can readily identify a picture of a housewife from wherever, but not a picture of Paul Ryan or Joe Biden.

Civil discourse seems gone - see this website for a quick example, we are now an entitlement nation where people no longer respect the ethic of working hard to earn their own way. We have a government trying to convince segments of our population they are not good enough to make it on their own. The value of life means nothing to many inner city kids, it goes on and on and on.

Houston, we have a problem and it's not guns, it's the people who use them and would use other weapons should guns be taken away.

For once I'd like to see politicians, and I don't care what party as they all share blame for being gutless wonders like the Tracy Press staff, to step up and do what's right, fix the real problem, then maybe, just maybe, we can start on the path to being the country our Founding Fathers envisioned.

Thomas Jefferson held a belief in the ability of the people to basically self govern with limited oversite by the government, we the people are failing miserably.

For some strange reason I felt compelled to read the comments here until I scrolled all the way down and read the comment where debdaves said she wants to shoot republicans. I don't own guns myself, but I do think debdaves should check in with a counselor. She has gone to a region called Internet troll and probably got her panties in a bunch just a little too tight.

backinblack I want to thank you for trying to clean up after the Tracy Press. I also believe they have gone downhill. Many people look the other way, but when people talk about things in town they share a knowing glance. With you I share this same gut feeling.

FYI I have seen other message boards where the owner will remove all comments by an Offender who continues to break the rules. They will ususally strip the offender's comments and replace it with the phrase, This Offender has been removed.

Message board owners have this capability, but many unrespectable message board owners refuse to honor their readers who actually follow the rules. They refuse to listen to the people who advertise and read their paper.

I do not always agree with everything you have to say backinblack, but this time I got to hand it to you. Keep up the good work. Hopefully the Tracy Press will come to their senses.

Media Quiet About San Antonio Theater Shooting

On Sunday December 17, 2012, 2 days after the CT shooting, a man went to a restaurant in San Antonio to kill his X-girlfriend. After he shot her, most of the people in the restaurant fled next door to a theater. The gunman followed them and entered the theater so he could shoot more people. He started shooting and people in the theater started running and screaming.



There was an off duty county deputy at the theater. SHE pulled out her gun and shot the man 4 times before he had a chance to kill anyone. So since this story makes the point that the best thing to stop a bad person with a gun is a good person with a gun, the media is treating it like it never happened.



Only the local media covered it. The city is giving her a medal next week.

Slinger, I've never really seen it as being too big of a deal when a discussion moves from one subject to another especially if it's a natural progession of the conversation. Example, it would be quite easy to go from a discussion on politics to a discussion on unions, to a discussion on teachers, then on to how we should revamp a failed education system.

The problem I have and if you scroll down to read my previous comments you will see I've tried to address this, is the TP staff constantly allows people to do nothing more than post hate mongering negative comments with no point other than making personal attacks.

I have a little news for you, based on 6 or 7 years of posting comments and writing letters I have come to what I believe is a reasonable assumption, the TP staff doesn't care about the threats, foul language, uncivil discourse, or personal attacks which go on here on a daily basis. They post rules yet despite open challenges and other forms of contact by myself and others, they do nothing.

Make your stand here. I hope others who feel the way I do will follow suit and do the same. TP needs to step up, they need to show some guts and start enforcing their rules.

This site has become so bad I actually stopped posting a few weeks ago but I still checked in to read comments. After seeing debbdaves openly opine about wishing she could shoot republicans I felt compelled to challenge the TP staff to basically man up and address the situation but they have failed miserably.

TP's rules: "This is not a space for personal attacks, libelous statements, profanity or racist slurs."

TP's rules: "and the writer responsible will be subject to being blocked from making further comments and have their past comments deleted."

Yea TP, whatever. When it comes to the latter you have proven yourselves gutless.

I agree with ya. I also expect TP will continue ta do nothin about it. An th newspaper industry seriously wonders why it's loosin it's readers? If ya noticed I don't comment as often as I use ta fer th same reasons that ya have tapered off. It seems that a meaningful dialog on th topic presented is not somethang TP is much interested in. So many people have come ta this conclusion they don't bother with TP in either th written or on-line form. I suspect th advertisers will quickly come ta th same conclusion an that will be th end of TP.

"Oh, we can fix that," an allow th same thing ta happen over an over again isn't gonna be very successful in th long run so in a year or so I suspect TP will finally close it's doors fer good an die a quiet death. Sad fer a local paper ta come ta that end but honestly th owners brought it on ta themselves.

I think backinblack is behaving in an appropriate and civil way.

To say that a woman can be treated different just because she is a woman may be what is wrong from both perspectives, but this may transcend your point and therefore it is a moot point. Back in black does not appear to be racist. Perhaps you meant male chauvenist? Or any other number of names. Who knows exactly what you are thinking doorsc but I see you made the same claim about Tracy on other news stories, so probably just your defacto accusation and the only talking point you know.

Now, if there is credence to what you say, let's hear it. in the meantime, the reason I think backinblack is right to call out the TracyPress is when ever someone threatens someone is the law and should not be treated as a get out of jail free card for only one segment of society if you agree with them or not.

What if someone had checked on MH after her first brush with the law; it would have prevented a travesty. But why does the same newspaper that received an award for reporting on MH stay quiet when another woman threatens people on a their own blog site when an article clearly says we need to scrutinize whack jobs?

And that is ok to turn a blind eye because of journalistic reasons? I personally do not think so because that was never consistent, but apparently there are those in journalism who think they have a right to protect freedom of speech when they think it best and when they do not it is also ok for them to delete comments.

I feel that if the Tracy Press if using doorsc logic, could be called racists for willy nilly picking and choosing when to delete comments, but I will not say that myself for sure, because I simply do not know why they do and if we used doorsc logic we could apply any name to anybody. What I do know is that backinblack has called the Tracy Press out. And there is a deafening silence in Tracy over this.

Tracy Press staff, hope you had a nice relaxing New years weekend. While you were away debbdaves has basically run amok on this website. In addition to just about every comment she posts going against your stated rules she made the referenced comment on Saturday. You have left this up for 4 days which I find both pathetic and disturbing.

This person looks to me as becoming unhinged, all anyone with common sense has to do is read her comments to see the signs.

Paranoia - thinking others are taking on multiple screen names to direct comments at her.

Delusion - accusing people of stances or writing something for which there is no record.

Denial - writing she wishes she can shoot republicans then turning around and writing she meant to type chute.

Loss of control and rational thought - her hate speech continues even after being called out by a number of people for openly opining about her desire to shoot people.

When are you guy's going to step up and handle this situation?

Tracy Press staff, I'm sure you guy's think this is a joke but what happens if this person decides to manifest her hate in a way that goes beyond her mostly despicable comments?

It's vexing to see what you guy's allow not only from her but also others who do nothing but post negative comments. Take a look at your site, personal vendettas, a few others in adddition to debbdaves actually making threats - this happens quite frequently under the police log or any other story about some of the criminals committing crimes for which you run stories.

Sure, any of us can email a complaint but why bother? From my experience and going by the comments of others in regards to the subject, you guy's rarely take action. This is my selected option, openly challenging you to take action and show those of us who come here hoping for civil public discourse you are serious about enforcing your code of conduct.

If you actually show the guts to take action don't do what you've done in the past by wiping out an entire comment section. Ban the person who is obviously the problem, remove their comments. Taking down the innocent with the guilty is not a good way to send a message.

Going back to "I wish I could shoot them", it is your responsibility to report this to Tracy PD as you are the ones who have continued to provide the forum for debbdaves to promote her hate which seems to be getting more out of control by the day.
