Marcus Rogokos is charged with attempted murder, use of a firearm in commission of a felony, intentional and personal discharge of a firearm, assault with a semiautomatic firearm, shooting at inhabited dwelling and stalking.
Rogokos appeared in custody in San Joaquin County Superior Court in Stockton at 9 a.m. Dec. 20, where defense and prosecution attorneys approved a hearing for 9 a.m. Jan. 3 in Department 25.
That court date will confirm a jury trial at 8:15 a.m. Jan. 4 to determine if Rogokos is mentally sound enough to be tried for his charges.
The accusations stem from a Jan. 13, 2012, incident in which he allegedly fired a handgun into the am-pm store at 2430 Joe Pombo Parkway around 8:40 a.m.
Police dispatch records the night of the alleged incident state a store clerk at the am-pm told police that someone in a red Honda had shot out his business window. Police arrested Rogokos during a traffic stop a few hours later.
Rogokos is being held in San Joaquin County Jail in French Camp without bail.
