UPDATE: Judge merges charges against Tracy man Print E-mail

A judge Thursday combined drug and weapon charges with a prior felony robbery charge against a Tracy man arrested Tuesday.


Kevin Silva of Tracy was arraigned on drug and weapon charges in a Manteca courtroom on Thursday, where a Superior Court judge decided to transfer his case to Stockton and combine it with a prior case in which he was charged with felony robbery.

 

Silva has been charged with possession of a controlled substance for sale, possession of cocaine, receiving stolen property, possession of cocaine while armed with a firearm and illegal possession of a firearm. Police arrested the 26-year-old man Tuesday night after he allegedly armed himself with a stolen shotgun when deputies attempted to serve a protective order, according to the San Joaquin County Sheriff’s Office.

 

The sheriff’s office reported deputies had gone to a home on the 2400 block of South Bird Road to serve the order at around 10 p.m. Tuesday. When they arrived, they knocked on the door and saw someone inside the home retreating into a back bedroom.

 

Deputies immediately ran to the house’s back door in an attempt to intercept the man. They said they then heard the sound of a pump-action shotgun being racked and saw a man standing inside the home holding a shotgun.

 

The man dropped the shotgun when ordered by the deputies and the weapon was confiscated.

 

During a search of the home, deputies found a bag of cocaine and a large roll of cash. Investigators determined 12-gauge shotgun was stolen, the sheriff’s office reported. Silva, was arrested and booked into the San Joaquin County Jail on Tuesday night and posted bail of $600,000 on Thursday.

 

A preliminary trial hearing is set for Sept. 10 at San Joaquin Superior Court in Stockton where defense attorney Timothy Rien will represent Silva.

Let's hope this guy is gone a long time and relocates upon release.
