Pay attention to track trespassers E-mail

A homeowner complains about those who break the rules and those who fail to enforce them.


EDITOR, 

Is there any enforcement of the “No Trespassing” signs on the railroad tracks that run along Byron Road between Corral Hollow and Lammers roads? Nearly every day, there are school kids and young adults walking on the railroad tracks. I know the spur is rarely used, but the tracks are raised along this stretch of roadway.

My home backs up to the tracks. I am only allowed a 6-foot privacy fence per city code. The raised tracks put the people walking along the tracks above my fence line.

Multiple times, I have found granite rocks from the tracks in my backyard. I have two small dogs that could be killed or seriously injured, not to mention that the windows at the back of my home could be broken.

If the city refuses to enforce the no-trespassing signs on the tracks, I should be allowed to build a higher fence for privacy and the safety of my home and family.

The city knows there is a problem along the stretch, because they are constantly painting over the graffiti that is on the track-facing side of the fence. So much for good, safe neighborhoods in Tracy.

Check with the city again. I believe the fence height is 8 feet.
10.08.3250 Wall, fence and hedge requirements.
Fences, walls, or hedges in all residential zones shall conform to the following conditions and requirements:
(a) The height of any fence, hedge, or wall shall be in accordance with all of the following:
(1) For any part of any lot not otherwise restricted, the maximum height shall be no greater than eight (8') feet;
(2) For any public easement, the maximum height shall be no greater than six (6') feet measured vertically from the top of the fence to ground level of the fence;

Without a permit you can NOT build a fence higher than 6'.

Be sure they are aware whether the land is contaminated along the rail tracks. That is chance they are taking if they are.

Did you not think of that BEFORE you bought the house? Your just like the people complaining about the airport but bought a house near it anyway.....and those poor Mountain House folks who have to deal with all that wind coming from those wind turbines.

Wow, Gary, does all that wind really come from wind turbines? I thought it came from mother nature. So do they like pump electricty up to the wind turbines to generate wind?
