Perennial campaigner Tom Benigno has filed papers to run for a seat on the San Joaquin County Board of Supervisors in 2008.

His opponent on the June 3 ballot is District 5 Supervisor Leroy Ornellas, a Tracy dairy farmer and incumbent who ran unopposed in the 2004 election.

Benigno has previously campaigned for the 17th Assembly District, Tracy mayor, 11th Congressional District and even governor. All those efforts have fallen short. But Benigno, who was once an elected member of the San Joaquin County Republican Central Committee, hopes that keeping in the public eye will boost his chances this year.

"I think they’re pretty good. I’ve got some name recognition," he said, adding that he considers himself an independent voter. "I think there’s an opportunity for anybody to get elected if they work hard enough."

Benigno said via a press release that he will campaign on an economic platform focused on bringing jobs to San Joaquin County and easing the pressure of a "deep recession" that has the county jobless rate at 10 percent and has seen thousands of foreclosures, though he was vague on details.

He also said that government accountability will be a big theme of the race.

"I want transparent government," he said. "Transparency means you have to have open doors to see what’s going on, and we’re not doing that."

But Benigno contends he shouldn’t have to face Ornellas on the ballot at all.

He claims the incumbent should not be allowed to run for another term of office because of the county’s Measure A, a law voters passed in 1998 that limits supervisors to two terms in office. Ornellas was originally elected to the 5th District in November 2002, when he beat Lynn Bedford, who was appointed to serve out the remaining term of Supervisor Robert Cabral, who died in office.

Ornellas himself said that his term-limit status was a concern for some time.

"It was an issue that was always in the back of my mind after I won the election to my first full term," he said.

A legal opinion written by County Counsel Dave Wooten and delivered to the San Joaquin County Registrar of Voters in July 2007 came down on the side of the incumbent:

"It is our opinion that Measure A restricts members of the San Joaquin County Board of Supervisors to two full four-year terms in office. Service of a partial term by appointment or election does not count as one of the two full four-year terms. Therefore, it is our conclusion that Supervisor Ornellas is eligible to run for office in the June 2008 primary…"

Ornellas pointed to the precedent set by a member of the Lincoln Unified School District Board who was elected to a second four-year term after originally coming to the board to serve a partial term. The Lincoln board operates under a term-limit statute modeled after the county’s Measure A.

Wooten also consulted the arguments in favor of the term-limits initiative that appeared on the 1998 ballot to try to capture Measure A’s intent before making a decision.

Benigno disagrees with the Wooten’s opinion and believes a ruling on the term-limits issue should be made on the state level.

"Quite a few people have read (the opinion) and feel as I do that it’s really ambiguous and leads us into an area where the county counsel makes change," Benigno said. "It should be a state decision-making process."

But the supervisor said he was "very comfortable" with his eligibility and is looking forward to running for and serving his last term, when he intends to see through several projects already in the works.

Ornellas says the big issues he’s working on include the expansion of San Joaquin County Jail, taking the final steps to bring a Veterans Administration clinic to French Camp and helping the many businesses that want to relocate to the county to navigate a maze of permits and politics.

Benigno, though, says it’s time to elect new blood to the board.

"We have messes going on in the board of supervisors," he said. "I think I can make a change."

A perfect example of the lack of leadership Tom would display at the County Government level...if he doesn't understand something he will ask the state what to do.

You would think the reporter would have asked Tom to elaborate on the "messes going on in the board of supervisors"...this and the comment about "transparency" infers that the five elected officials are involved in some kind of collusion...I believe everything is public record...Tom should request whatever documents he needs to prove something fishy is abound.

Mr Benigno wrote this one year ago. This demostates why Mr Benigno should not be elected to any office. Its all public information, still in the archives of the Tracy Press.

Steve, is Tom running for City Council? You don't even understand the difference between a city councilman and a supervisor.

Ubbo, that isn't an insult on troops. His comments are true for a percentage of the troops he is referring to. The only problem I can see is that it is a generalization, and so maybe he could have qualified his comments a bit better. Most debates involve someone telling the other person that they are making a generalization that is not true, that is the only error he made there. Out of all of the screwed up comments he has posted on these forums, I think you deserve an F- for finding dirt. I would never vote for you for any position after seeing your lack of intelligence. And if you ever do run for office, I'll send out a few direct mailings with every stupid half-baked comment you've made on these forums and elsewhere.

As for the Mr. Banana discussions. Those were not Tom, but likely someone getting his opinion on what to write before writing it. Tom's level of grammer did not match those postings.

TRACY - Voters won't have Tom Benigno to kick around anymore.
After four failed campaigns for state, federal and local offices, a gubernatorial bid that never got off the ground and an unsuccessful try for a Tracy City Council appointment in the past seven years, the farmer-turned-perpetual political candidate says he no longer will seek elected office.
What began with a run for the 17th Assembly District seat in 2000 to counter a state law allowing farmers markets to set up in the streets quickly grew into a quixotic quest that netted Benigno a total of just 16,000 votes four elections later. After being passed over for appointment to a vacant seat on the Tracy City Council in December, Benigno called it quits.
"I burned myself out," the 71-year-old Tracy resident said.

Ok, so what's going on here is that some banana wants to run against Ornellas.

We in Tracy know about the ranting on the TP website. As other posters have mentioned you can just google or yahoo "tracypress tom benigno".

But here is where it get's interesting. This story isn't just about some colorful banana. It is also about Larry.

Larry hasn't had his name out there for a few elections. He needs name recognition. Some voters just vote for the name they can recall. Sadly, but yes it's true.

Anyway, if Benigno's name is not tarnished after all the rant and the failed campaigns and Ornellas doesn't get his name out there he could lose.

However, you have to ask yourself if you believe that would ever happen. Could it? We'll just have to wait and stay tuned. I guess this means no more Citizens Voice?

Either way may the best man win. Good luck Ornellas! if you can keep it going then go for it! Good luck Benigno! You still have something to contribute???

Supervisor Ornellas has represented the 5th district very well has goals as stated in the article and is also trying to bring a regional park to Tracy. He has my vote and support and deserves your's as well.

I URGE you to research or read what that person has written about me and then ask yourself why can't he take it if he can dish it out! He is a public figure, I'll go back and reprint every negative and ignorant thing he ever wrote. I probably don't need too because his reputation will beat me to it. Your opinion is that he didn't insult the troops, and thats fine its your opinion. In fact, I also drove out there last weekend.

INTERESTING OBSERVATIONS:
-The old stink from the Holly Sugar factory is gone.
-There were ducks sitting in the water treatment area.
-Its all gone, all cleaned up now.
-Does anyone know when the sugar-cut was removed?
-Does anyone know when the odor was last noticed?
-Great location for a sports park in Tracy?
-I hope some in the county think so too!!!

One more thing...
Without the odor from Holly Sugar... When I went to the nearby driving range it was a pleasant experience.

That got me thinking... A Wetlands! A Sports-Park! This all smells like a great idea! Thanks Supervisor Ornellas!!!

You just did challenge my character by your indirect comments. Who are you to challenge anyone's character because they don't fit your intolerant narrow view of the world?

There are people who join the guard for exactly the reasons why Benigno stated. There are people who join the guard for those reasons plus if America is attacked they want to be prepared to help defend it. There are people who join the guard and who would do it for free. There are people who probably have scores of other reasons for joining the guard.

Tom's comments on these forums are shocking, and I would never vote for him because of those comments, but the one you are latching onto is pure politics and suggests that you want to spin anything you can to inflict maximum damage on someone you don't like. Be honest, this is personal for you, you dislike him, he made it personal.

If Tom wins in November it will either be because Leroy didn't try to win, or for the same reasons that Tucker keeps getting re-elected: people know the name, but nothing about the person.

At this point I think this is the best chance Tom has of winning an election.

Why don't you run against Tom and Leroy?

Politicans like Pombo have done more damage to this country's future that any terrorist has. I know, your right-win intolerant view of the world says that anyone who waves the flag and says they are christians, and most importantly does everything possible to destroy our country's future, is a conservative republican. You guys are warped.

I once called myself a conservative republican when that meant being fiscally responsible, having a strong military, and helping businesses thrive. Now I call the people who call themselves conservative republicans as "corrupt republicans", looters.

Today's corrupt republicans are about looting America's future, destroying America's military thru decades of deficit spending. These irresponsible self-centered republicans have put us over $9 trillion in debt, and now Arnold is doing the same thing to the State of California. 5% of that is $450 billion a year. Today as a country we have $450 billion less a year to build a stronger military because of the looters known as conservative republicans. I know that isn't completely accurate because of the money games we've been playing in looting social security to pay for our deficits.

The irresponsible 1998 tax change that gives homeowners a $500,000 tax free profit on their homes is what drove this incredibly damaging increase in new home prices: this is a complete disaster that is likely the beginning of the economic collapse of our country. Who put thru that irresponsible tax change that created the current mess we are in? Pombo and the Pombo conservative republicans, and most importantly the voters who put them in office such as yourself. Who failed to curb the lending abuses until the housing market collapsed, the conservative republicans.

The federal government is now freaking out because they finally understand how dire our situation is. This is really really really bad, and sadly it has been predicated for years. It personally shows me that the people in Washington really don't understand what is happening in our country.

I saw egrets standing around at Holly site, but no water yet? At least I didn't see any water on my drive to see the place.

Why don't we take a survey of the staff and students at North School about the odor and when was the last time they noticed it?

On my researches the new treatment for waste treatment is to treat the waste treatment inside the plant with "bullrush", explained on the sportspark website: http://www.tracysportspark.com
before releasing it to wetlands, about 98 percent of the odor was removed before the remaining 2 non-odor percent is taken care of by the wetlands.

I was looking at the land and could see place for where the bike rental shop and picnic area could be. Maybe even new addition like Japanese Garden next to the wetlands? So many possibilities, so promising for the city of Tracy?

I've enjoyed your posts. What sort of a vision do you think they should have? Should they continue to have grand visions that further bury us in debt?

What do you think of these potential points?

1) have a strong military

2) get America out of debt within 20 years. Have a plan, and each year make the tough budget decisions to get us to the 20 year goal in 20 years

3) aggressively build America's competitiveness in the world

3) aggressively protect America's borders

4) save social security so that we have a minimum social net for our fellow countrymen

5) undo the trillions of dollars in new spending that Bush has enacted to get republicans reelected

6) protect U.S. jobs

7) have a national plan for fighting the economic war

I always laugh when I read something like this. Why? For all the hoopla that was generated by Councilwoman Tucker's alleged attempts to conceal public record, it strikes me odd how anyone would the have the audacity to complain about anyone actually going and looking through public records.

No FBI-type of investigation, just going down to the county and reading all the public records, which is the right of any citizen, or at least what it seems to be the rights that everyone gets so worked up over.

So you might want to look at yourself a little more seriously before you speak out about what someone has done in the past as an independent citizen of our community.

As a completely private citizen, am I really that much of a threat to you and your cause? Wow! And all along I didn't think that I was much of a threat to anyone.

With respect to Tom. You won't be seeing Citizens Voice for awhile as he asked the city to stop running the show so as not to run afoul of Federal Campaign laws. I suppose he somehow knew that I would be checking into that. OOPS! I forgot, I am not supposed to look into things like that am I?

I will say one thing about a lot of the political pandering I see going on in the City as of late. At least I can honestly say in public that I live here and not live under the mass delusions that seem prevalent in these forums when selecting which "community member" or "resident" that I want to listen to and have any faith in.

You see I actually live in Tracy, unlike many who live in Manteca and other surrounding communities outside of the sphere of influence that comprises the City of Tracy. You might want to look into those people as well to determine what their motives of self-interest might be. Just a thought, you are free to believe anything that you want to believe for what ever reason that seems to be justified to you.

But you don’t really do your cause justice when you claim you don’t like those who use character assassination and yet are guilty of doing the same against those you disagree with.

Tom is no stranger to the public (and posting on the internet)? Right? Perhaps he can do the "Citizen's Voice" on youtube.com, or something, so we can all continue to watch it? Would that be a violation of campaign laws?
